Indefinition about mandatory NF-e is still great

SÃO PAULO - A portion of companies that are required to issue the Electronic Invoice (NF-e) - one of the pillars of the Public Digital Bookkeeping System (Sped) - as of 2010 has no idea of ​​this need. The information is contained in a survey released by IOB Soluções.

According to the survey, which heard about 280 companies from different fields of activity, 52% of them had already been in duty since April last year; 29,8% need to do so starting in September. Finally, only 6,2% stated that they need to transmit information from 2010, showing a gap of 12%. In addition, of all non-obliged companies, 37% did not even assess whether they were in need.

“From what we have researched, part of the companies is not effectively monitoring the adhesion to Sped. As there are three projects [in addition to NF-e, Sped Contábil and Sped Fiscal], there is a lot of confusion ”, pondered the company's Solutions director, José Adriano Pinto.

IOB Soluções recalled that in July this year, ICMS Protocol 42 listed 556 codes of economic activity required to generate the document. In an article published at the time, the FinancialWeb Expert Roberto Dias Duarte gave examples of the expansion of mandatory requirements, which reached three protocols.

“The previous wording was: XXII - wholesale traders of oil-based lubricants and greases and was changed to: XXII - wholesale traders of lubricants and greases derived or not from petroleum. In other words, this sector now has an expansion of obligated economic activities ”, he commented.

The issuance of the protocol also raised doubts about the deadline for accession. In it, some sectors that should have already joined the system in September, were identified as belonging to the group that started in 2010. “The project's coordination published clarification on this, informing that there was no extension”, he guaranteed.

In September this year, another 54 sectors will enter the system. The NF-e replaces format 1 and 1A and its adoption does not impact the commercial activity of companies, according to the Federation of Industries of the State of São Paulo (Fiesp). Today, almost 8 thousand companies are NF-e issuers. In the period, more than 86 million invoices were authorized (until 8/7/2009) and an average of more than 13 million monthly authorizations.



 
Still, according to IOB Soluções, 52,6% of the companies declared that, even outside the requirement, they intend to anticipate the implementation of the NF-e. In the institution's assessment, this can be explained by the fact that 83,4% consider that the project offers more benefits than difficulties.
