Repetitive Resources Law makes 1 year

Law 11.672 / 08, which defined a new rite for the judgment of repetitive special appeals at the Superior Court of Justice (STJ), completed one year in force last Saturday. The results encourage the Judiciary throughout the country, especially the STJ. In just 12 months, the law reduced by 34% the number of cases that went up to court, as expected by the president of the STJ, Minister Cesar Asfor Rocha. In all, 124 repetitive appeals were posted for judgment in the special court and in the three sections of the STJ.
“The law made it possible for the STJ to work for a quick, efficient and effective Justice”, says Asfor Rocha. “It is a democratic instrument, insofar as there is no imposition to adopt our guidance, but, if a court decides differently to the understanding established here, the parties will know in advance that the decision will be reformed if there is an appeal to the STJ ”, He explains.
For the court ministers, the reduction in the number of appeals on common topics, with identical issues, allows more time for the in-depth analysis of new and nationally relevant matters. For the citizen, the measure represents a faster judicial provision, with the final solution of actions already in second instance.
In one year, the law proved to be efficient to face the mountain of lawsuits, thereby giving prestige to the principles of legal certainty and predictability of decisions, evaluates the president of the STJ.
