General impact reflects the reduction in the number of cases

BRASILIA - The majority of the almost 47 thousand Extraordinary Appeals sent to the Supreme Federal Court (STF) arrive without the justification for the existence of General Repercussion, according to court data. The STF gives General Repercussion actions the status of relevant issues from a social, economic, political or legal point of view with the aim of filtering processes and thus making Justice more agile.

According to the STF, of the resources destined to the court, 73% did not come with this justification. Among the Appeals, processes that request the raising of Extraordinary Resources to the Supreme Court, the total with and without preliminary General Repercussion is just over half of the more than 80 thousand received in the period (58,11%).

Today, more than 39 thousand Extraordinary Resources are processed at the STF, of which 33.897 without the preliminary general repercussion and 5.661 with the preliminary. Among the interlocutory appeals, 53.795 are being processed in court today. Among them, 29.940 are processes without preliminary general repercussion and 23.855 contain a separate chapter, with the preliminary. The information is from the Supreme Court.

Process reduction


Despite the fact that most resources do not use General Repercussion as a justification, there was a 63% reduction in the number of cases distributed to ministers in relation to the same period in 2007, when this procedural filter did not yet exist. Among all the cases referred to the Supreme Court with preliminary general repercussions, the majority (20.386) came from the State Justice, followed by those from the higher courts (11.322). Following are the cases sent from the five Federal Regional Courts (6.210) and other courts (5.457). The smallest portion comes from the Federal Special Courts Appellate Classes (2.803).

In State Justice, the record holders in sending cases with General Repercussion to the Supreme Court, until July this year, are the Court of Justice of São Paulo (1.299), followed by the TJ de Minas (1.232) and the TJ of Rio Grande do Sul ( 683).

Among the Superior Courts, the Superior Labor Court surpassed the other Superior Courts in 2008. In total, 4.250 cases were distributed with preliminary general repercussions from the Labor Court in 2008, followed by 2.177 cases from the Superior Court of Justice, 103 are from the Superior Electoral Court and four from the Superior Military Court. In 2007, STJ was the leader, with 257 cases, followed by TST, with 77, TSE, with 26, and STM, with three.

The leader in the ranking of the Federal Regional Courts is the 4th Region (Porto Alegre). Between January and July 2009, 779 cases were recorded.
