Taxes and smuggling outperform tobacco

In the first nine months of the year, revenues from Souza Cruz, the largest cigarette manufacturer in the country, fell 8%, to R $ 4,06 billion. The final result, in the last line of the balance, had an even greater impact, around 10%. Even so, manufacturing and marketing such a stigmatized product, the target of all sorts of campaigns and regulations, remains a good deal. The profit of R $ 1,1 billion represents a return of more than 25% on revenues, a rate rarely found in Brazil.

Not by chance, Souza Cruz's shares are among Bovespa's top 5 stocks: according to a survey by the consultancy firm Economatica, with a 57,3% appreciation until October, its shares only lost to those of Lojas Renner (63,4%) and surpassed those of the third place, Ambev (40%). "Our shares are preferred by investors who have a long-term horizon, who are preparing for retirement," says Paulo Ayres, director of planning at Souza Cruz.

In principle, Ayres' statement may seem like a paradox, in the case of cigarettes, a marked product, if not to die, at least to undergo close surveillance by anti-smoking movements and governments. In fact, the weight of tobacco control and prohibition measures or restrictions on advertising appear to be less feared than other opponents, such as smuggling and heavy taxation, which reach 63% of the value of each packet.

In fact, for manufacturers in the industry, the two factors seem to go hand in hand. According to Ayres, the increase in smuggling, which had been manifesting since the beginning of the 1990s, did not reflect even with the adoption, in 1999, of adREM, a taxation system that affects the price of each pack of cigarettes according to the type of packaging and the brand, regardless of the final retail price. "Between 2000 and 2009, cigarette revenue grew 66%, against 18% for drinks," says Ayres, refuting criticisms that the current system would be harmful to public coffers. On the contrary, by not directly affecting the final price, taxation would be preserving the collection. "It prevents the government from funding a price war between manufacturers," says Ayres.

Paraguayan production. For him, the current structure has caused a substantial increase in the price of cigarettes. "A study by FGV shows that we are among the five most expensive markets in the world," he says. The high internal cost, added to the appreciation of the real, ends up stimulating illegal trade, via smuggling from Paraguay, a country that houses about 40 factories and has an annual production capacity of 40 billion cigarettes, equivalent to more than a third of the Brazilian , around 110 billion units. "Half of Paraguayan production comes to Brazil without paying taxes there or here," he says. “While the pack of Souza Cruz's cheapest brand, Derby, costs R $ 3,35, contraband cigarettes can be purchased for R $ 1,30.” According to Ayres' calculations, this means that at least R $ 2 billion in taxes per year has been lost.

 

Operation Padlock catches fuel smuggling in the border region

The military involved in Operation Padlock, commanded by the Western Military Command, seized on the first day of Operation Padlock a smuggled batch of fuel and even wild animals.

In the Amambaí region, a city 346 km from Campo Grande, close to the border with Paraguay, men from the 17th Motorized Cavalry Brigade seized a large number of baby parrots.

The correct number was not released, but according to the Army, baby birds were apprehended and sent to the Military Environmental Police and the perpetrators were caught in the act for environmental crime.

In Ponta Porã, the military seized three amateur radio stations used for clandestine communication. According to Colonel Cardozo, from 14 BCM, radios interfere with the communication of official bodies and can even hinder the communication of aircraft and police communication radios.

Also in Ponta Porã, 535 liters of gasoline without original invoice were seized. The fuel was being smuggled from Paraguay to Brazil and the driver of the vehicle was arrested and sent to the Federal Police of Ponta Porã.

In Dourados, twenty bales with material from contraband were seized. According to military information, the boxes contained Christmas decoration material and electronics.

The Padlock operation started last Friday (5th) and will continue until the next 14th in several points of the border region.

Police break up in Paraíba gang that acted in RN

A joint operation between the Federal, Federal Highway, Civil and Military police, in addition to the Federal Revenue Service, managed to break up in the city of Patos a gang that acted in cargo theft and cigarette smuggling with branches in the states of Paraíba, Ceará and Rio Grande do North. In the operation called Catenga, 11 arrest warrants were carried out.

All arrests took place in the city of Patos and the Federal Police seized approximately 10 counterfeit cigarette cases. During the action, three military police officers were arrested in the 3rd Battalion of Military Police of Patos. One of them, José Tarcísio Mendes Gomes, is appointed as the leader of the gang. The other two, Ewerton Carvalho Barbosa and Rubenilton dos Santos Barbosa, served as scouts to facilitate the passage of goods, the result of cargo theft or smuggling from Paraguay, which came from São Paulo and Paraná camouflaged in trucks loaded with fruits and vegetables.

All material had as its final destination the city of Patos and were transported in trucks that were prepared to hide illicit cargo. “They put cigarettes in trucks together with fruits and vegetables to disguise the inspection. The military police used the function of public security authority to circumvent the inspectors and pass, without any problem, on the existing barriers on the roads ”, added Paulo Henrique de Lima, PF delegate. Arriving in Patos, the products were stored in the houses belonging to the group and distributed to several commercial regions of Paraíba, Rio Grande do Norte and Ceará.

According to the Federal Police, products were obtained in various ways. One of them was the import of cigarettes from Paraguay, however, the gang also carried out robberies against deposits by companies and sold the material with fake stamps from the IRS.

The gang was led by military police officer José Tarcísio Mendes Gomes, with the participation of two more police officers. They were responsible for circumventing road inspections in order to let the material pass.

The Federal Police, with the support of the Federal Highway Police, the Military Police and the Internal Revenue Service, launched Operation Catenga this Tuesday morning (19), in order to dismantle one of the largest armed gangs in the Northeast involved in the illegal sale of contraband cigarettes, cigarettes stolen by cargo theft from regular companies, as well as cigarettes with a false seal of tax control.

The name, which means Gecko, is an allusion to the nickname used by one of the main targets of the Operation. The investigation began in September 2008 after a cigarette seizure in the city of Pombal / PB. Since then, based on a controlled action granted in court, it has been possible to make several flagrant arrests and cigarette seizures over the years 2009 and 2010.

With the deepening of the investigations it was possible to reach those responsible not only for the logistics of buying, selling and transporting the cigarette, but also for the financing of the criminal actions, which yielded expressive values, making it possible to purchase and flaunt various vehicles and properties.

The gang's modus operandi was the importation of cigarettes of Paraguayan origin, the robbery of deposits by regular companies and the purchase / sale of cigarettes with a false IPI stamp. Such goods were transported to the city of Patos / PB in trucks specifically prepared to hide the illicit cargo. After remaining in storage in this city, the cargo was distributed in small cars to several cities in Pernambuco, Paraíba, Rio Grande do Norte and Ceará.

In all, in addition to blocking the bank accounts of the main investigated persons, 13 (thirteen) preventive arrest warrants are being carried out in the states of Paraíba and Ceará, 16 (sixteen) search and seizure warrants in the states of Paraíba, Ceará, São Paulo and Paraná, as well as warrants for kidnapping and seizure of assets.

PF launches operation against sale of medicines over the internet

Criminals used websites, classified in newspapers, forums and social networks to sell anabolic steroids, abortion pills, appetite suppressants, home medicines and unregistered formulas.

The Federal Police launched this Tuesday (19), with the support of the National Health Surveillance Agency (Anvisa), Operation Panacea against the sale of medicines over the internet. The action takes place in 45 countries associated with Interpol, the international police.

According to the PF, 20 search and seizure warrants are being carried out in the states of Rio de Janeiro, Maranhão, Minas Gerais, São Paulo, Paraíba, Santa Catarina and Ceará. Criminals used internet sites, classified in newspapers, forums and social networks to sell anabolic steroids, abortion pills, appetite suppressants, home medicines and unregistered formulas.

The Federal Police say that the purchase of medicines over the internet can involve major health risks. There are records of drugs that have less or more of the active ingredient.

In Brazil, the sale of drugs without a license or adulteration are heinous crimes, whose sentences can reach up to ten years in prison and a fine.

Pharmacies that sold irregular medicines in Minas are prohibited by Anvisa

3.000 pills of sexual stimulant smuggled from Paraguay were found. The inspection also seized expired drugs.

According to the chief of the operation, which was carried out on Friday, one of them will be charged for the crime of drug trafficking, for selling prescription drugs without a prescription and also for illegal possession of weapons. The other owner was arrested for the crime of falsifying medicines.

Counterfeit cigarettes are seized in police operation

An operation carried out over this week in the São Luís Metropolitan Region resulted in the seizure of 23 wallets of counterfeit and smuggled cigarettes. The cargo, according to the Civil Police, was sold illegally in a small trade called Comercial Rouba Pequeno, located in the João Paulo neighborhood.

“We took steps and inspected several commercial establishments in the municipalities of São José de Ribamar and Paço do Lumiar. Today (yesterday), we had information that Comercial Rouba Pequeno, near João Paulo's Fair, was selling imported cigarettes. The product had no invoice ”, explained Chief Breno Galdino, from the State Superintendence of Criminal Investigations (Seic).

At the apprehension site, on Avenida Projetada, a woman identified as Lídia de Sena, 51, born in Coroatá, was summoned to appear on Monday, 18, at the headquarters of Seic, to provide clarification on the purchase of the product. As explained by Galdino, two of the three brands collected have prohibited sales in Brazil.

“Derby, US and TC were found. In the first, the product was falsified. The next two are smuggled and, therefore, are forbidden to sell in the country. In all, 24 boxes of cigarettes were seized ”, informed the Seic delegate who, until the closing of this edition, continued to inspect other commercial points in the capital.

Operation Smokescreen arrests 12 people in northern Minas Gerais
